Manning was trying 'to hopefully save lives,' lawyer says in final argument

FORT MEADE, Md. ? Pfc. Bradley Manning, accused of the biggest leak of classified material in American history, is not a traitor but a young, well-intentioned man who was ?trying to ply his knowledge to hopefully save lives,? his lawyer argued Friday.

In a closing argument at Manning?s court-martial, the lawyer, David Coombs, said that Manning ?felt a duty to everyone? and was following the principles on which the country was founded.

The judge in the case, Army Col. Denise Lind, will decide whether Manning is guilty. She said she would begin deliberations Friday night and would provide a day's notice before delivering the verdict.?

Coombs, who quoted from the inscription on the Statue of Liberty?s pedestal in his argument, ended with a series of questions:

?Is PFC Manning someone who has no loyalty to this country or the flag, and wanted to systematically harvest and download as much info as possible for his true employer Wikileaks? Is that what the evidence shows?? he asked.

?Or,? he continued, ?is he a young, na?ve but good-intentioned soldier who had human life and his humanist beliefs center to his decision, whose sole focus was: Maybe I just can make a difference, maybe make a change.?

Manning, 25, has said that he sent the information, which included diplomatic cables and battlefield reports, to the anti-secrecy website WikiLeaks because he was disillusioned by a U.S. foreign policy bent on ?killing and capturing people.?

Several members of the public in the gallery applauded when Coombs finished, drawing a rebuke from the judge: ?This is a court of law. I ask that you please keep your reaction muted.?

In a one-hour prosecution rebuttal that followed the defense's closing argument, Maj. Ashden Fein pushed back on the defense assertion that Manning was a na?ve, good-intentioned young man, saying instead that Manning admitted in an online chat that he had been "penetrating" the military computer system for more than a year.

"He knew exactly what he was doing," Fein said, adding that Manning's actions represented "general evil intent" and were "not well-intentioned."

Fein said that Manning sought out "the type of information the enemy seeks, they want worldwide," and that because of Manning's actions, "that was given to them in searchable format." Manning identified weakness and then exploited them, Fein said, adding that he knew the information would be distributed worldwide.

On the idea that Manning was a whistleblower, Fein said that Manning did not read hundreds of thousands of State Department cables and then take any concerns up the chain of command.? "He found something he knew would get published online because it was significant enough," Fein said, adding that in online chats Manning called himself a "hacktivist."

Manning turned his back on his country and soldiers, Fein said, "he knew the scope of his actions" and "he cared about no one but himself."

When he was finished, Judge Lind announced that she will go "straight into deliberations this evening."

She also explained that once she is ready to announce her verdict, she will alert the attorneys and then make her announcement the following day.

On Thursday, a military prosecutor invoked Osama bin Laden in a closing argument that portrayed Manning as a man who aided the enemy when he provided more than 700,000 documents to WikiLeaks.

Manning pleaded guilty to 10 charges that carry up to 20 years in prison, but prosecutors pushed ahead with more serious counts, including larceny, aiding the enemy and violating the Espionage Act. Those charges could land Manning in jail for life.

Manning has been jailed at Fort Leavenworth, Kan., since April 2011 and was at the military prison in Quantico, Va., for nine months before that.

Coombs said in his closing argument that prosecutors? case was a ?fictional story that they have drafted in their mind,? and that it was ?an inconvenient truth? for the government that Manning wanted to save lives.

As for why Manning downloaded hundreds of thousands of pages of government documents onto CDs, Coombs said that there were really no clear rules in the secure area where Manning worked in Iraq.

Also Friday, the judge banned a sketch artist, Clark Stoeckley, from the rest of the trial, citing inappropriate behavior. In a statement, the military said that a member of the media had been barred for posting threatening messages regarding some participants in the court-martial.

Stoeckley, a supporter of Manning who had media credentials to cover the court-martial, said on his Twitter feed: ?Thank you for your concern. I?m fine.?

The body of a bride-to-be was pulled from the Hudson River on Saturday afternoon, close to the scene where she had plunged into the water after a horrific boat accident on Friday night.

Authorities found the body of 30-year-old Lindsey Stewart floating with no life vest near the Tappan Zee Bridge, around 25 miles north of New York City.

The boat's operator Jojo John, 35, has been charged with vehicular manslaughter for his role in the tragedy, as well as for vehicular assault.

Mark Lennon, also 30, who was to be best man at the wedding in only two weeks time, remains missing after hours of desperate searching.

Stewart's fianc?, Brian Bond, 35, was knocked unconscious and fractured an eye socket after the bridal party's powerboat struck a parked barge while crossing the river at 10.30 pm on Friday.?

The crash happened shortly after the 21-foot Stingray left the village of Piermont for a short trip across the river to Tarrytown, authorities said.

Four other people, including the groom-to-be, were hospitalized with serious injuries after being pulled from the damaged boat.

NBC reported that the victims have head trauma and broken bones, but they are awake and are giving information to investigators.

Bond was knocked unconscious in the crash but later woke and was able to call 911, Stewart's mother Carol said.

Carol said earlier on Saturday that she was praying for a miracle. Lindsey Stewart was to be married on August 10.

The bride-to-be's mother told ABC: 'She's supposed to be married two weeks from today. It just can't end like this.'

Lindsey Stewart's stepfather, Walter Kosik, said the couple have known each other since they were 10 years old and used to go to church together.

'They have been friends the whole time, and they fell in love about 3 1/2 years ago,' Kosik said.

They were to be married at the Good Shepherd Lutheran Church in Pearl River, with a reception at a Hudson Valley winery, he said.

The New York Daily News reported that alcohol is being investigated as a potential cause for the crash.?

According to the paper, the bride-to-be worked as an art teacher in Westchester County while her fiance worked in insurance in Nyack.

Rockland County Sheriff's Department Chief William Barbera said the barge, one of several loaded with construction material for an upcoming replacement of the bridge, was equipped with lights, but it was still difficult to see on the water so late at night.

The cause of the accident is under investigation.

The New York State Thruway Authority, which is overseeing the bridge project, said it was reviewing safety procedures.

'Our thoughts and prayers are with the victims and their families during this difficult time,' the authority said in a statement. It added that the lighting on the barges appeared to be functioning normally.

Pile driving that had been scheduled to take place Saturday was suspended because of the accident.

Anthony Apolito, 18, a restaurant valet, saw the survivors being carried ashore by emergency services.

He told the New York Post: 'There was a lot of people that didn't look too conscious and a lot of people in neck braces. One guy, his face was covered in blood.

'They were still stunned from the crash, they didn't know what was going on,' Apolito added.

There are a number of barges located both north and south of the Tappan Zee bridge as construction begins on a replacement for that aging structure that is scheduled for completion in 2017.

Apple reportedly second biggest smartphone shipper in the world

Market share remains the most popular metric to calculate among metric calculators, and last quarter their measures claim Apple shipped the second largest amount of smartphones in the world at 31.2 million, representing a 13.1% slice of the customer pie. IDC reports:

Apple posted its second-lowest year-over-year iPhone growth rate in almost four years as some buyers presumably held off on iPhone purchases in advance of an expected next-generation device launch this fall. Nonetheless, the 31.2 million iPhones Apple shipped last quarter was impressive as its flagship iPhone 5 model, which has been in the market for three quarters, was faced with additional global competition in the form of Samsung's Galaxy S4 and HTC's critically-acclaimed One models. Apple's growth is likely to accelerate globally assuming it launches a lower-cost iPhone and continues to penetrate prepaid markets in the quarters to come.

Samsung took the top spot at 72.4 million units shipped, for a 30.4% share, and LG rounded out the top three with 12.1 million and 5.1%. When it comes to all phones, not just the smart ones, Samsung jumps to a whopping 114.4 million units but only a 26.2% share, because Nokia remains on that particular chart with 61.1 million units for 14.1%.

So, while Apple moved more units than this time last year, Samsung moved way more units, and that brought Apple's overall moved-units number down. (Nokia moved way less units than they did this time last year, but not way-enough-er to fall below Apple yet when you count dumb-phones, which Apple doesn't make.)

What does this tell us? Once again as much or as little as we want to read into it. In terms of gross trends Samsung is shipping a ton more, smartphone and dumbphone both. Nokia is shipping a ton less, but their dumbphone share is still significant. And Apple is still growing, though not as fast as Samsung. Smartphones are also still growing, and we're increasingly approaching the time when almost all phones are smart.

Once again, these are estimated units shipped only, not necessarily units sold (because most manufacturers not named Apple don't report actual sold-to-customer numbers). It doesn't cover profit share, usage share, customer satisfaction (customer sat!) or anything else.

Apple entered the market with Nokia (Symbian) and BlackBerry at the top of the charts, and they're still in the game now that Samsung fills the shelves.

The assumption about the less expensive iPhone is interesting, however. Apple hasn't announced such a product, though it's been rumored for several years. Recently sales of the 2011 iPhone 4 have grown, due to its relatively low cost. That's pushed down Apple's average selling price, costing them margin and ultimately profit.

That's the thing about the market share game. You can't just play it, you have to play it well. So far, historically, Apple's done that best on profit, Samsung increasingly on volume. Now maybe we'll start to see each broaden their plays. Interesting times.

If you have a Craigslist account, you can sign into it and start posting right from the app. The main page of Craigslist is set up like a newspaper, which may make it easier for those new to Craigslist.

If you find yourself only posting or trading things occasionally rather than on a regular basis, or if you're brand new and want something easy to use, Craigslist by Lifelike is a great choice. (It's also universal for iPhone and iPad.)

Mokriya

Mokriya has the best Craigslist interface available. Everything from how listings appear to how you search for items is just presented wonderfully. It's got buttery smooth transitions and lays out images in-ad in a really convenient way, making it easy to flip through them quickly. I really wish Mokriya was available for the iPad because browsing the galleries would just be a treat. It's also free for basic features, with a $0.99 in-app purchase (IAP) for premium features like notifications and the ability to post.

Smobile is the fastest Craigslist app on the market. It's slimmed down and concentrates on showing listings quickly and efficiently.
